Harassment and Bullying

Purpose

This policy aims to create and maintain a safe, respectful, and inclusive community within [Condominium Name] by establishing clear guidelines and procedures for addressing harassment and bullying. This policy applies to all residents, owners, tenants, guests, staff, contractors, and board members.

Definitions

  • Harassment: Any unwanted behavior, comment, gesture, or conduct that is known or ought reasonably to be known to be unwelcome. This can include, but is not limited to, verbal abuse, threats, intimidation, stalking, unwanted sexual advances, or displays of offensive materials.

  • Bullying: Repeated and aggressive behavior intended to harm or intimidate another person, either physically or emotionally. Bullying can be verbal, physical, social, or cyberbullying.

Prohibited Conduct

The following conduct is strictly prohibited within the condominium community:

  • Verbal harassment, including insults, derogatory comments, slurs, or threats.

  • Physical harassment, including assault, battery, or unwanted physical contact.

  • Sexual harassment, including unwanted sexual advances, requests for sexual favors, or other verbal or physical conduct of a sexual nature.

  • Stalking or cyberstalking.

  • Intimidation or threats.

  • Bullying, including repeated aggressive behavior, spreading rumors, social exclusion, or cyberbullying.

  • Display of offensive materials, such as racist, sexist, or homophobic images or symbols.

Reporting Procedure

Any individual who experiences or witnesses harassment or bullying within the condominium community should report the incident to the Condominium Council as soon as possible. Reports can be made verbally or in writing to the Council President, Property Manager, or any other designated Council member.

All reports will be treated confidentially and investigated promptly. The identity of the complainant will be protected to the extent possible.

Investigation and Resolution

The Condominium Council will investigate all complaints of harassment or bullying thoroughly and impartially. The Council may interview the complainant, the alleged harasser/bully, and any witnesses.

If the Council determines that harassment or bullying has occurred, appropriate action will be taken. This may include, but is not limited to, the following:

  • Issuing a verbal or written warning to the harasser/bully.

  • Requiring the harasser/bully to attend counseling or training.

  • Imposing fines or other sanctions.

  • Suspending or revoking privileges.

  • Evicting the harasser/bully (if applicable).

  • Reporting the incident to law enforcement (if appropriate).

Confidentiality

All information related to complaints of harassment or bullying will be kept confidential to the extent possible, except as necessary to conduct a thorough investigation or to comply with legal requirements.

Retaliation Prohibited

Retaliation against any individual who reports harassment or bullying or who participates in an investigation is strictly prohibited. Any individual who engages in retaliation may be subject to disciplinary action.

Review and Updates

This policy will be reviewed and updated regularly to ensure its effectiveness and relevance.

Effective Date

This policy is effective immediately upon approval by the Condominium Council.
