Purpose

Definitions

  • Open Flame: Any fire source that is not fully enclosed, including but not limited to candles, barbeques, fire pits, torches, and incense.

  • Strata Lot: An individual unit within the condominium, including balconies and patios.

Policy

  1. Prohibition of Open Flames in Common Areas: The use of open flames is strictly prohibited in all common areas of the condominium.

  2. Restricted Use of Open Flames in Strata Lots:

    • Balconies and Patios: The use of propane or natural gas barbeques is permitted on balconies and patios, provided they are used in accordance with manufacturer instructions and local fire codes.

    • Indoor Use: The use of candles and incense is permitted within strata lots, but must be attended at all times and extinguished when unattended.

    • Prohibited Items: The use of fire pits, torches, and other open flame devices is prohibited within strata lots and on balconies/patios.

  3. Exceptions:

    • Special Events: The Strata Council may grant temporary exceptions for the use of open flames during approved events, subject to appropriate safety measures being in place.

    • Religious or Cultural Practices: Reasonable accommodation may be made for open flames used in religious or cultural practices, provided they adhere to safety guidelines and do not pose undue risk.

Enforcement

The Strata Council is responsible for enforcing this policy. Any reported or observed violations may result in:

  • Verbal or written warnings

  • Fines as outlined in the bylaws

  • In severe or repeated cases, legal action may be taken

Amendments

This policy may be amended by a ¾ vote at a general meeting of the owners, following the procedures outlined in the Strata Property Act and the condominium bylaws.
