Unit Access
Purpose
To establish clear guidelines for when and under what conditions the Condominium Corporation or its representatives may enter a unit owner's private dwelling.
Policy
Consent: The preferred method of entry into a unit is with the express consent of the unit owner or occupant. Consent may be given verbally, in writing, or electronically.
Notice: Except in emergency situations, the Condominium Corporation will provide the unit owner with reasonable written notice of its intent to enter the unit. The notice will include the date, time, reason for entry, and the names of those who will be entering. "Reasonable notice" shall be defined as 24 hours' notice, unless otherwise agreed to by the unit owner.
Emergencies: The Condominium Corporation may enter a unit without consent or prior notice in the following emergency circumstances:
To respond to a fire, flood, or other situations that threaten life or property.
To prevent significant damage to the common property or to another unit.
To address a clear and immediate threat to the health or safety of occupants or others.
Repairs and Maintenance: The Condominium Corporation may enter a unit to conduct repairs or maintenance work:
That is the responsibility of the Corporation under the Condominium Act or bylaws.
That is necessary to prevent damage to the common property or to another unit.
Where the unit owner has failed to conduct necessary repairs or maintenance after being given notice and a reasonable opportunity to do so.
Inspections: The Condominium Corporation may enter a unit to conduct inspections:
As required by law or regulation.
As outlined in the Condominium Act or bylaws.
In response to a reasonable complaint or concern about the condition of the unit or its potential impact on the common property or other units.
Access: When entering a unit, the Condominium Corporation or its representatives will use the least intrusive means possible and will respect the privacy and belongings of the unit owner.
Documentation: A record of all entries into units, including date, time, reason, and names of those entering, will be maintained by the Condominium Corporation.
Exceptions
This policy does not apply to situations where a court order or warrant has been issued authorizing entry into a unit.
Review
This policy will be reviewed annually and updated as necessary to ensure compliance with all applicable laws and regulations.
