Doors and Windows
Purpose:
This policy is established to ensure the consistent appearance and structural integrity of the condominium complex, while allowing unit owners reasonable flexibility in maintaining and improving their individual units.
Scope:
This policy applies to all exterior doors and windows within the condominium complex, including those that are part of individual units and those that are considered common property.
Definitions:
Exterior Doors and Windows: All doors and windows that form part of the exterior envelope of the building, including but not limited to:
Unit Doors and Windows: Doors and windows that provide direct access to and from individual units.
Common Property Doors and Windows: Doors and windows located in common areas, such as hallways, lobbies, and amenity spaces.
Repair: The restoration of a door or window to its original condition, functionality, and appearance.
Replacement: The removal and installation of a new door or window in place of an existing one.
Alteration/Modification: Any change to the size, shape, style, or material of a door or window.
Policy Guidelines:
Repair and Maintenance:
Unit Owners' Responsibility: Unit owners are responsible for the repair and maintenance of their unit's exterior doors and windows, including but not limited to:
Weatherstripping and caulking
Hardware (locks, handles, hinges)
Painting or staining (interior and exterior surfaces)
Strata Corporation's Responsibility: The Strata Corporation is responsible for the repair and maintenance of common property doors and windows.
Reporting Issues: Unit owners should promptly report any issues with their unit's doors or windows to the Strata Corporation.
Replacement:
Prior Approval Required: Unit owners must obtain written approval from the Strata Council before replacing any exterior door or window.
Conformity to Standards: Replacement doors and windows must conform to the Strata Corporation's design guidelines, including but not limited to:
Color
Material
Style
Energy efficiency
Professional Installation: Replacement doors and windows must be installed by a qualified professional.
Alteration/Modification:
Prohibited: Alterations or modifications to exterior doors and windows are generally prohibited.
Exceptions: In exceptional circumstances, the Strata Council may approve minor alterations or modifications if they do not affect the structural integrity, energy efficiency, or overall appearance of the building.
Enforcement:
Failure to comply with this policy may result in the following:
Notice to Comply: The Strata Corporation will issue a written notice to the unit owner, requiring them to rectify the non-compliance within a specified timeframe.
Fines: If the non-compliance is not rectified within the specified timeframe, the Strata Corporation may impose fines as outlined in the bylaws.
Legal Action: In severe cases, the Strata Corporation may initiate legal action to enforce compliance.
Dispute Resolution:
Any disputes arising from this policy will be resolved in accordance with the Strata Property Act and the Strata Corporation's bylaws.
Review and Amendment:
This policy will be reviewed annually and may be amended from time to time by the Strata Council.
